Terms and Conditions - Dove Campaign For Real Beauty Survey

  1. These terms set out the basis on which the Promoter is conducting the Dove Campaign for Real Beauty Survey. Information on how to vote in forms part of these conditions.
  2. Participation is limited to residents of Australia and New Zealand.
  3. The promoter and the Service Providers do not accept responsibility for any lost or misdirected vote registrations.
  4. Participants are invited to express their opinion (a "vote") regarding the appearance of six women presented to the public in the Campaign for Real Beauty via either the 'Campaign for Real Beauty' website, or the SMS service.
  5. Your use of, and/or access to the SMS or 'Campaign For Real Beauty' website constitutes your agreement to the Terms of Use. The promoter reserves the right to amend these terms at any time.
  6. To register a vote via 'Campaign for Real Beauty' [http://www.campaignforrealbeauty.co.nz] website, complete all sections of the online survey, follow the prompts to register your vote on what your opinion is of the six (6) women featured. The times of the opening and closing of the 'Campaign For Real Beauty' voting via the website are 1st April 2006 to 31st Dec 2006
  7. 'Campaign For Real Beauty' SMS voting service will be from 00:00:01 1st April 2006 and will continue until 23:59:59 1st July.
  8. Any costs associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid.
  9. To cast a SMS vote, using the 'Campaign For Real Beauty' SMS Voting Service, you must send a text message from your mobile handset, with only one of the following to describe the image you have seen that you want to vote for. For SMS voting in New Zealand text your vote to 3535.

  1. When registering your vote using the 'Campaign For Real Beauty' SMS voting service, you will receive an SMS message in return to confirm your vote has been received.
  2. 'Campaign For Real Beauty' SMS Voting is open to New Zealand users who are connected on 025, 027, 021, 029 mobile phones.
  3. Only one letter can be sent for each SMS vote. Entries with more than one letter will be void
  4. You must ensure that all care is taken when sending messages to the SMS voting services. It is your responsibility to ensure that you SMS the correct letter. The Promoter, and the voting service provider will not be liable for costs incurred, responses received or any other consequences of user error.
  5. Votes registered using the 'Campaign For Real Beauty' SMS voting service in New Zealand will be charged 50 cents (including GST).
  6. Any SMS votes submitted and received by the Traction database after the specified voting period has closed will not be included in the vote tally for that period but will still be charged the SMS entry cost. (50 cents including GST, New Zealand users respectively.)
  7. The Promoter will allocate all amounts received by it from SMS providers (being 20 cents per SMS in New Zealand) to the Dove Self Esteem Fund which will be directed to initiatives supporting self esteem in girls aged 11 to 14 years.
  8. Under no circumstances (including but not limited to any act or omission on the part of the Promoter and the Service Provider) will the Promoter or Service Provider be liable for any indirect, incidental, special and/or consequential damages or loss of profits whatsoever which result from any use or access of, or any inability to use or access the SMS or online voting services.
  9. Except where not able to be excluded by law: a) all content for voting services are provided "as is" and without warranties of any kind, either express or implied, b) Your mobile telephone carrier and its suppliers expressly disclaim all warranties of any kind including but not limited to implied warranties of merchantability and fitness for a particular purpose, c) Neither your mobile telephone carrier nor the Promoter or the voting Service Provider warrants that access to both the SMS or online voting services will be available, uninterrupted, free from delay or error-free or that any defects will be corrected.
  10. The charges for all SMS voting Services will appear on your next mobile / telephone bill or deducted automatically from your prepaid balance (NZ users only). All queries relating to mobile / telephone bills should be directed to your mobile or telephone carrier.
  11. All information, text, audio, material, graphics, software and advertisements contained in or forming the Voting Services ("Content") are the property of or licensed to the Promoter, its suppliers and/or licensors (including your telephone carrier) unless expressly indicated otherwise. The Content is protected by Australian and international copyright and trademark laws. You must not modify, copy, reproduce, republish, frame, upload to a third party, post, transmit or distribute this Content in any way unless expressly authorised in writing by the Promoter.
  12. SMS is not a guaranteed delivery communication tool. The Promoter and the Service Provider cannot accept responsibility for any SMS messages not received, any SMS reply message or for any delay in the delivery of the SMS message due to technical disruptions, network congestion, network failures or for any other reason. A vote is validated and included in the tally following receipt into the Traction database from the carriers.
  13. If for any reason this voting service is not capable of running as planned, due to causes including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this voting service, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with the voting process, take any action that may be available, and to cancel, terminate, modify or suspend the voting service.
